1. AGREEMENT TO TERMS
Agreement is between the user (hereinafter referred to as the "User") and XUEJIN DESIGN (hereinafter referred to as the "Service Provider"). By accessing this website or using any software applications, games, and digital services (collectively, the "Services") developed by the Service Provider, the User agrees to be bound by these Terms of Service. If any part of these terms is not agreed upon, the use of the Services must cease immediately.
2. BETA AND EARLY ACCESS SERVICES
Certain Services may be released in alpha, beta, or early access versions ("Beta Services") to test performance and features. The User acknowledges that Beta Services are provided "AS IS" and may contain bugs, be incomplete, or result in data and progress resets. The Service Provider shall not be liable for any loss of data, progress, or functionality during the beta testing period.
3. WEBSITE AVAILABILITY (SITE UP TIME)
The Service Provider takes all reasonable steps to ensure that this website is available 24 hours every day, 365 days per year. However, websites may encounter downtime due to maintenance, server issues, or technical difficulties. Consequently, the Service Provider will not be liable if the website is unavailable at any time or for any period. Access to the website may be suspended temporarily and without notice.
4. INTELLECTUAL PROPERTY RIGHTS
The Services, including but not limited to visual assets, game mechanics, source code, music, and artistic content, are the exclusive intellectual property of the Service Provider. License: Users are granted a limited, non-exclusive, and non-transferable license to access the Services for personal, non-commercial entertainment purposes only. Prohibitions: Users may not reproduce, distribute, modify, or create derivative works based on the Services without prior written consent from the Service Provider.
5. USER RESTRICTIONS
By utilizing the Services, the User agrees to the following restrictions: No attempt shall be made to decompile, reverse engineer, or extract the source code of any software contained within the Services. The Services shall not be used for any fraudulent, illegal, or unauthorized purposes. The User shall not interfere with or disrupt the integrity or performance of the Services.
6. HEALTH AND SAFETY WARNING (PHOTOSENSITIVE EPILEPSY)
The Services may contain flashing lights, rapid rhythmic patterns, or other visual sequences that may trigger seizures in individuals with photosensitive epilepsy. User discretion is advised. If the User experiences dizziness, altered vision, or muscle twitches while using the Services, they must discontinue use immediately and consult a medical professional.
7. DISCLAIMER AND LIMITATION OF LIABILITY
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the Services. The total liability of the Service Provider shall not exceed the amount actually paid by the User (if any) for the Services.
8. DISPUTE RESOLUTION & REGIONAL TERMS
U.S. RESIDENTS: All disputes arising from the Services shall be resolved through binding individual arbitration. The User expressly waives the right to a trial by jury or to participate in a class-action lawsuit.
EU RESIDENTS: The Service Provider acknowledges mandatory consumer protection laws. Users in the EU/EEA may have a statutory right to withdraw from purchase contracts for digital content within 14 days, provided that performance has not begun with the user’s prior express consent.
GOVERNING LAW: Except where prohibited by local law, these terms are governed by the laws applicable to the Service Provider's place of registration.
